3. General information and mandatory details
Data Privacy
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.
When you use this website, various personal data are collected. Personal data is information that can be used to identify you personally. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.
We point out that data transmission over the Internet (e.g., when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.
Note on the controller
The controller for data processing on this website is:
etiam GmbH
Stadtweg 22
33178 Borchen
Germany
Managing Director: Artjom Wismann
Phone: +49 (0) 5251 69448 10
Email: info@etiam.de
The controller is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g., names, email addresses, etc.).
Storage duration
Unless a more specific storage period has been stated in this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a justified request for deletion or revoke your consent to data processing, your data will be deleted, provided we have no other legally permissible reasons for storing your personal data (e.g., tax or commercial retention periods); in the latter case, deletion will take place after these reasons no longer apply.
General information on the legal basis for data processing on this website
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, provided that special categories of data are processed according to Art. 9(1) GDPR. In the event of express consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or access to information on your device (e.g., via device fingerprinting), data processing is additionally based on Section 25(1) TTDSG. Consent can be revoked at any time. If your data is required for the fulfillment of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if it is required to fulfill a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also take place on the basis of our legitimate interest according to Art. 6(1)(f) GDPR. Information on the relevant legal basis in each individual case is provided in the following paragraphs of this privacy policy.
Note on data transfer to the USA and other third countries
We use tools from companies based in the USA or other third countries that are not secure under data protection law, among others. When these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that in these countries, a level of data protection comparable to that of the EU cannot be guaranteed. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. It can therefore not be excluded that US authorities (e.g., intelligence services) process, evaluate, and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You may revoke consent you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
WHERE DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work, or the place of the alleged infringement. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a standard, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognize an encrypted connection by the fact that the browser's address line changes from "http://" to "https://" and by the lock symbol in your browser line.
When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Information, deletion, and correction
Within the framework of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this or any other questions about personal data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:
- If you contest the accuracy of the personal data we have stored, we generally need time to verify this. For the duration of this verification, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was or is unlawful, you may request the restriction of data processing instead of deletion.
- If we no longer need your personal data, but you require it for the exercise, defense, or establishment of legal claims, you have the right to request the restriction of the processing of your personal data instead of its deletion.
- If you have filed an objection pursuant to Art. 21 (1) GDPR, a balancing of your interests and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data—with the exception of its storage—may only be processed with your consent, for the establishment, exercise, or defense of legal claims, for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a member state.
Objection to advertising emails
The use of contact details published in the context of our mandatory legal notice for the purpose of sending unsolicited advertising and information materials is hereby prohibited. The site operators expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam emails.
4. Data collection on this website
Cookies
Our website uses "cookies." Cookies are small text files that do not harm your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.
In some cases, cookies from third-party companies may also be stored on your device when you enter our site (third-party cookies). These enable us or you to use certain services provided by the third-party company (e.g., cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or display advertisements.
Cookies that are required to carry out the electronic communication process (necessary cookies), to provide certain functions you have requested (functional cookies, e.g., for the shopping cart function), or to optimize the website (e.g., cookies for measuring the web audience) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of their services. If consent to the storage of cookies has been requested, the relevant cookies are stored exclusively on the basis of this consent (Art. 6(1)(a) GDPR); consent can be revoked at any time.
You can configure your browser to notify you about the placement of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for specific cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.
If cookies from third-party companies or for analytical purposes are used, we will inform you about this separately within the framework of this privacy policy and, if necessary, request your consent.
Server log files
The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Hostname of the accessing computer
- Time of the server request
- IP address
This data will not be merged with other data sources.
This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of their website—server log files must be collected for this purpose.
Contact form
If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We will not share this data without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if it has been requested; consent can be revoked at any time.
The data you enter in the contact form will remain with us until you request its deletion, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions—especially retention periods—remain unaffected.
Inquiries via email, telephone, or fax
If you contact us by email, telephone, or fax, your request, including all resulting personal data (name, request), will be stored and processed by us for the purpose of handling your inquiry. We will not pass this data on without your consent.
This data is processed on the basis of Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of requests addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time.
The data you send to us via contact requests will remain with us until you request its deletion, revoke your consent for storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions—in particular statutory retention periods—remain unaffected.
Email security: Transport encryption (TLS) active; end-to-end encryption only by separate arrangement.
Comment function on this website
For the comment function on this site, in addition to your comment, information about the time the comment was created, your email address, and, if you do not post anonymously, the username you have chosen will be stored.
Storage of the IP address
Our comment function stores the IP addresses of users who post comments. Since we do not check comments on this website before they are published, we require this data in order to be able to take action against the author in the event of legal violations such as insults or propaganda.
Storage duration of comments
Comments and the associated data are stored and remain on this website until the commented content has been completely deleted or the comments must be deleted for legal reasons (e.g., offensive comments).
Legal basis
Comments are stored based on your consent (Art. 6(1)(a) GDPR). You may revoke any consent you have given at any time. An informal notification by email is sufficient for this purpose. The legality of data processing operations already carried out remains unaffected by the revocation.
5. Analytics and advertising
Google Tag Manager
We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. The Google Tag Manager itself does not create user profiles, store cookies, or perform independent analyses. It is used solely for the management and deployment of the tools integrated through it. However, Google Tag Manager does collect your IP address, which may also be transmitted to Google's parent company in the United States.
The Google Tag Manager is used on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the quick and uncomplicated integration and management of various tools on their website. If consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; consent can be revoked at any time.
Google Analytics
This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics allows the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, duration of visit, operating systems used, and the user's origin. Google may consolidate this data into a profile that is assigned to the respective user or their device.
Google Analytics uses technologies that enable user recognition for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google regarding the use of this website is generally transmitted to a Google server in the USA and stored there.
The use of this analysis tool is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analyzing user behavior to optimize both its website and its advertising. If consent has been requested (e.g., consent to the storage of cookies), processing is based exclusively on Art. 6(1)(a) GDPR; consent can be revoked at any time.
Data transfer to the USA is based on the European Commission's standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.
IP anonymization
We have activated the IP anonymization feature on this website. As a result, your IP address will be truncated by Google within member states of the European Union or other contracting states to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, compile reports on website activity, and provide other services related to website and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data held by Google.
Browser plugin
You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.
For more information on how Google Analytics handles user data, please refer to Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.
Data processing agreement
We have entered into a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.
Demographics in Google Analytics
This website uses the "Demographics" feature of Google Analytics to display relevant advertisements to website visitors within the Google advertising network. This allows reports to be generated that contain information about the age, gender, and interests of site visitors. This data is derived from interest-based advertising from Google as well as visitor data from third-party providers. This data cannot be attributed to any specific individual. You can disable this feature at any time via the ad settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the "Objecting to data collection" section.
Storage duration
Data stored by Google at the user and event level that is linked to cookies, user identifiers (e.g., User ID), or advertising IDs (e.g., DoubleClick cookies, Android advertising ID) will be anonymized or deleted after 14 months. You can find further details at the following link: https://support.google.com/analytics/answer/7667196?hl=en
6. Newsletter
Newsletter data
If you would like to receive the newsletter offered on this website, we require an email address from you, as well as information that allows us to verify that you are the owner of the provided email address and agree to receive the newsletter. No further data is collected, or it is collected only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.
The processing of data entered into the newsletter subscription form is based exclusively on your consent (Art. 6(1)(a) GDPR). You may revoke your consent to the storage of your data and email address, as well as their use for sending the newsletter, at any time, for example via the "Unsubscribe" link in the newsletter. The legality of any data processing operations already carried out remains unaffected by your revocation.
The data you provide for the purpose of receiving our newsletter will be stored by us or our newsletter service provider until you unsubscribe from the newsletter, at which point it will be deleted from the newsletter mailing list. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest under Art. 6(1)(f) GDPR.
Once you unsubscribe from our newsletter mailing list, your email address may be stored in a blacklist by us or our newsletter service provider to prevent future mailings. Data from the blacklist is used solely for this purpose and is not merged with other data. This serves both your interests and our own in complying with legal requirements for sending newsletters (legitimate interest pursuant to Art. 6(1)(f) GDPR). There is no time limit on storage in the blacklist. You may object to this storage if your interests outweigh our legitimate interest.

10. Proprietary Services
Handling of Applicant Data
We offer you the opportunity to apply to us (e.g., via email, post, or our online application form). Below, we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data will be in accordance with applicable data protection law and all other legal provisions, and that your data will be treated with strict confidentiality.
Scope and Purpose of Data Collection
When you submit an application to us, we process the associated personal data (e.g., contact and communication details, application documents, notes from interviews, etc.) to the extent necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG (initiating an employment relationship), Art. 6(1)(b) GDPR (general contract initiation), and—if you have provided consent—Art. 6(1)(a) GDPR. Consent can be withdrawn at any time. Your personal data will only be shared within our company with individuals involved in processing your application.
If your application is successful, the data you submitted will be stored in our data processing systems for the purpose of carrying out the employment relationship, based on Section 26 of the German Federal Data Protection Act (BDSG) and Art. 6(1)(b) GDPR.
Data Retention Period
If we are unable to offer you a position, you decline an offer, or you withdraw your application, we reserve the right to retain the data you submitted based on our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months after the end of the application process (rejection or withdrawal of the application). Subsequently, the data will be deleted and physical application documents destroyed. Retention serves primarily as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period (e.g., due to an impending or pending legal dispute), deletion will only take place once the purpose for further retention no longer applies.
Longer retention may also occur if you have provided your consent (Art. 6(1)(a) GDPR) or if legal retention obligations prevent deletion.
Inclusion in the Applicant Pool
If we do not offer you a position, there may be an opportunity to include you in our applicant pool. If you are included, all documents and information from your application will be transferred to the applicant pool so that we can contact you regarding suitable vacancies.
Inclusion in the applicant pool is based solely on your explicit consent (Art. 6(1)(a) GDPR). Providing consent is voluntary and has no bearing on the current application process. You may withdraw your consent at any time. In this case, the data will be irrevocably deleted from the applicant pool, provided there are no legal retention requirements.
Disclosure: internally only to those involved in the process.
Data in the applicant pool will be irrevocably deleted no later than two years after consent is granted.
